Personal data in the digital power of attorney
The Danish Customs and Tax Administration (Skatteforvaltningen) is the data controller for the personal data that we process about you. Here, you find further information about why and how we process your personal data of the data related to your personally owned business when you give or request a power of attorney from us via the Digital Power of Attorney option. This site is for both principals and agents.
Depending on the power of attorney in question, it is processed by the Tax Agency or the Motor Vehicle Agency which are part of the Customs and Tax Administration.

We process data about you that is essential for us to do our job as an autority.
In this specific case, the purpose is to verify that you can give or accept a power of attorney for our self-service system. Subsequently, we will store the information in order to be able to document the existence of the power of attorney.
We only process the personal data for which we have a legal and professional processing purpose and which we deem necessary to support the tasks that we carry out in the exercise of the official authority vested in us.
In connection with the specific task, we may, for example, process the following types of ordinary personal data about the principal and the agent:
- identification details such as name, address, civil registration number or CVR number;
- status (deceased, placed under guardianship, cessation, etc.)
- SE number/VAT number - name, address, CVR number, type (such as sole proprietorship) status (ceased, under administration, etc.) and the CPR number of the business owner
We process your personal data in accordance with Article 6(1)(e) of the General Data Protection Regulation (Databeskyttelsesforordningen) and your CPR number in accordance with section 11 of the Danish Data Protection Act (Databeskyttelsesloven).
Special legislation
Our official tasks are generally defined in section 1 of the Danish Tax Administration Act (Skatteforvaltningsloven) which states, among other things, that we must administrate the legislation on taxes and duties. The right to be represented or assisted by another person in dealings with us is linked to the right of party representation under section 8 of the Public Administration Act (Forvaltningsloven). Our access to cross-checking information is set out in section 67a and section 68 of the Tax Control Act (Skattekontrolloven).
When you set up or request a power of attorney via digital power of attorney, we process your and your representative's personal data in order to verify your identities.
We use data from MitIDE and MitID for businesses, including CPR and CVR numbers. We get the data you have stated in the online power of attorney in order to set up the power of attorney arrangement.
We disclose personal data to the following recipients and groups of recipients:
- other citizens and businesses when we're obliged to do so. It could be that we have a duty to forward information to others as part of reasoning in a decision or upon request for right of access, a possible spouse for example
- other public authorities when we deem the data to be of significant importance to their official tasks or to the extent that we as a public authority have a statutory duty to make such disclosure. Including the Police Force, the Tax Appeals Agency, the Department of the Ministry of Taxation, the courts, Udbetaling Danmark, municipalities, non-Danish tax authorities and Statistics Denmarkndigheder og Danmarks Statistik.
Some of our IT suppliers process your personal data on our behalf and according to our instruction
We only retain and process your personal data as long as the power of attorney is valid. After expiration of the power of attorney, the personal data may be will be retained and accessible for you with your municipality for 6 years.
In certain cases, we may transfer personal data to third countries in connection with double taxation agreements and other international agreements. You can read about the basis for transfer etc. in the section Is data transferred to non-EU/EEA countries (third countries)? here.

When we process personal data about you, you have the right to:
- have incorrect information corrected
- obtain insight into our processing of your data, including a copy of your data.
In some cases, you also have the right to:
- have the information erased or to restrict our processing of it
- object to our processing of your information.
